Kukulla — Terms of Service

1. Introduction
Welcome to Kukulla!
Kukulla is an Albanian-language entertainment and educational platform featuring animated videos, interactive games, quizzes, stories, and other learning experiences designed for children and families.
Kukulla.com and the Kukulla mobile application (collectively, the “Services”) are operated by Instahub Inc., a company registered in Canada.
By creating an account, accessing, or using Kukulla, you agree to these Terms of Service. If you are a parent or legal guardian permitting a child to use Kukulla, you agree to these Terms on your own behalf and are responsible for supervising the child’s use.
If you do not agree to these Terms, please do not use the Services.
2. Eligibility and Parental Responsibility
Kukulla is intended for children and families.
Account registration is intended for parents or legal guardians. Children should access the Services under the supervision and authorization of a parent or guardian.
Parents and guardians are responsible for:
Creating and managing family accounts.
Providing accurate account information.
Supervising children’s use of Kukulla.
Managing child profiles and privacy settings.
Keeping account credentials secure.
Contacting us about privacy, safety, or account concerns.
Child profiles are intended for use within a parent- or guardian-managed account and are not independent adult accounts.
3. Our Services
Kukulla may provide:
Albanian-language animated videos and children’s stories.
Educational games and interactive activities.
Quizzes, riddles, and learning challenges.
Personalized child profiles.
Watch history, bookmarks, and playlists.
Learning progress and educational results.
Additional family-oriented experiences introduced over time.
We may add, modify, suspend, or discontinue features when reasonably necessary for improvements, maintenance, safety, licensing, or operational reasons.
We do not guarantee that every video, game, or feature will remain permanently available.
4. User Accounts
Certain features require a registered account.
Users must provide accurate information when registering and must not impersonate another person.
Parents and guardians are responsible for maintaining the confidentiality of account credentials.
You agree to notify us if you believe your account has been accessed without authorization.
We may restrict or suspend accounts where necessary to investigate security issues, prevent misuse, comply with legal obligations, or protect users.
5. Child Profiles and Educational Progress
Kukulla may allow parents and guardians to create child profiles using a nickname, age, and selected avatar.
Each profile may have its own viewing preferences, playlists, quiz answers, and educational progress.
Scores, badges, grades, or results displayed in Kukulla are provided for entertainment and informal educational purposes.
Kukulla is not an accredited educational institution. Its learning results do not constitute official school grades, certifications, or assessments of a child’s academic ability.
We cannot guarantee uninterrupted synchronization of progress during network outages or technical failures.
6. Intellectual Property
Unless otherwise indicated, Kukulla’s original animated characters, videos, illustrations, games, branding, designs, software, and other original content are owned by Instahub Inc. or used under appropriate authorization.
This includes original Kukulla productions and associated character-based series.
You may access and enjoy the content for personal, non-commercial use in accordance with these Terms.
Without authorization, you may not:
Reupload or redistribute Kukulla videos or games.
Sell or commercially exploit Kukulla content.
Reproduce or imitate protected Kukulla branding in a misleading manner.
Claim ownership of Kukulla’s original characters or productions.
Circumvent technical protections or access restrictions.
Copy or modify substantial portions of Kukulla’s software without permission.
These Terms do not transfer ownership of intellectual property to users.
7. Acceptable Use
Users agree not to misuse Kukulla or interfere with its operation.
Prohibited activities include:
Attempting unauthorized access to accounts or administrative systems.
Interfering with the availability or security of the Services.
Uploading malicious files or harmful content.
Using automated systems to abuse platform features.
Submitting unlawful or infringing material.
Using Kukulla content or technology in ways that violate applicable laws or the rights of others.
We may take appropriate action when these Terms are violated.
8. User Submissions and Content Suggestions
Kukulla.com may provide opportunities to submit ideas, feedback, drawings, or other materials.
By submitting materials, you confirm that you have the necessary rights and permissions to provide them.
You retain ownership of your original submissions.
Unless separate terms are agreed, you grant Instahub Inc. a non-exclusive, worldwide, royalty-free license to review, store, and use submitted materials to respond to your request and evaluate possible content ideas.
We will obtain separate permission before publicly featuring identifiable children’s images, voices, or personal artwork where such permission is required.
Submitting an idea does not guarantee that Kukulla will produce, publish, or compensate anyone for that idea.
Additional terms may apply to custom video requests, collaborations, or promotional campaigns.
9. Third-Party Services
Kukulla relies on third-party infrastructure to operate features such as authentication, account storage, video delivery, and hosting.
These providers may include Google Firebase, Railway, and Bunny.net.
Your use of certain features may be subject to applicable third-party technical requirements and service availability.
We are not responsible for interruptions caused by third-party services beyond our reasonable control, but we will take reasonable steps to maintain and restore Kukulla’s services.
10. Privacy and Children’s Information
Your privacy and children’s information are important to us.

Parents and guardians should review that policy before creating family accounts.
We aim to collect only the information reasonably necessary to provide our services and support child safety.
11. Free and Paid Features
Certain Kukulla features may be provided free of charge.
We may introduce paid subscriptions, premium content, personalized videos, or other purchases in the future.
If paid services become available, applicable pricing, payment terms, renewal conditions, cancellation rights, and refund rules will be disclosed before purchase.
Where purchases are made through Google Play, applicable Google Play billing requirements will be followed.
No subscription or payment obligation is created merely by accepting these Terms.
12. Service Availability
We aim to provide a reliable and accessible experience, but we cannot guarantee that Kukulla will always operate without interruptions.
Maintenance, software updates, third-party outages, device compatibility, or internet connectivity may affect availability.
We may modify or temporarily suspend features for security, maintenance, or operational reasons.
13. Account and Data Deletion
Parents and guardians may request deletion of their accounts and eligible associated personal information.
Requests may be submitted through our account deletion process or by contacting:
Account deletion may result in the permanent loss of child profiles, playlists, saved preferences, and educational progress.
Certain information may be retained where required or permitted by applicable law, as explained in our Privacy Policy and Account Deletion Policy.
14. Disclaimer
Kukulla provides entertainment and informal educational content.
While we strive for age-appropriate, accurate, and useful learning experiences, we do not guarantee that all educational content will be error-free or suitable for every child’s individual needs.
Parents and guardians should exercise their own judgment when selecting content and supervising children.
To the extent permitted by applicable law, the Services are provided without guarantees of uninterrupted availability or error-free performance.
Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.
15. Limitation of Liability
To the extent permitted by applicable law, Instahub Inc. will not be liable for indirect, incidental, or consequential losses arising from the use or unavailability of the Services.
This limitation does not apply where liability cannot legally be limited, including rights arising under applicable consumer protection laws.
16. Changes to These Terms
We may update these Terms to reflect changes in the Services, legal requirements, or operational practices.
The effective date will be updated when changes are made.
Where legally required, we will provide additional notice or seek consent before material changes take effect.
17. Governing Law
These Terms are governed by the applicable laws of the Province of Ontario and the federal laws of Canada, subject to any mandatory consumer protection or privacy laws that apply in a user’s jurisdiction.
